Copyright & Content Takedown Policy
DMCA Notice & EU DSA Notice-and-Action Procedure
Effective Date: 23 March 2026
1. Overview
Modelium Club (“we”, “us”, “our”) respects the intellectual property rights of others and expects all users and Creators to do the same. This Copyright & Content Takedown Policy explains how to report infringing content on our platform and how we respond.
This Policy operates under two frameworks:
- The Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512 — applicable to copyright claims from all jurisdictions;
- The EU Digital Services Act (DSA), Regulation (EU) 2022/2065 — applicable to illegal content reports from users within the European Union and EEA.

We are a hosting platform and intermediary. We do not proactively monitor all content uploaded by Creators. However, upon receiving a valid notice, we act expeditiously to remove or disable access to the reported content.
2. Reporting Infringing or Illegal Content
2.1 Copyright Infringement (DMCA Takedown Notice)
If you believe that content available on Modelium Club infringes your copyright, please submit a written notice to dmca@modelium.club containing ALL of the following elements (required under 17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work: describe the original work(s) you claim has been infringed, including any copyright registration number if available.
- Identification of the infringing material: provide the specific URL(s) on https://modelium.club where the allegedly infringing content is located, with enough detail for us to locate it.
- Your contact information: your full name, postal address, telephone number, and email address.
- Good faith statement: a statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement: a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Signature: your physical or electronic signature (typing your full name counts as an electronic signature).
Incomplete notices may not be actioned. We reserve the right to request additional information.
2.2 EU DSA Notice-and-Action (Illegal Content)
If you are located in the EU/EEA and wish to report content that you believe is illegal under EU or national law (e.g. content infringing intellectual property rights, content violating consumer protection law, or otherwise illegal content), you may submit a notice under the EU Digital Services Act.
Your DSA notice must include:
- A sufficiently substantiated explanation of why you consider the content to be illegal, referencing the specific law or regulation allegedly violated.
- A clear indication of the electronic location of the content (URL).
- Your name and email address (unless the report concerns content that could endanger your life or safety, in which case you may remain anonymous).
- A statement confirming your good faith belief that the information provided is accurate and complete.

We will acknowledge receipt of DSA notices and inform you of the outcome of our assessment in a timely manner.
3. Our Response Process
Upon receiving a valid and complete notice, we will:
- Acknowledge receipt within 3 business days;
- Review the notice and the reported content;
- If the notice is facially valid, disable access to or remove the reported content within 5 business days (or sooner where urgency requires);
- Notify the Creator (uploader) that their content has been removed and provide a copy of the notice (with your contact details redacted if appropriate);
- Maintain a record of the notice for legal compliance purposes.
We reserve the right to restore content if we determine the takedown notice was invalid, erroneous, or made in bad faith.
4. Counter-Notice Procedure (DMCA)
If your content was removed as a result of a DMCA takedown notice and you believe the removal was erroneous or based on misidentification, you may submit a Counter-Notice to dmca@modelium.club containing:
- Identification of the removed material and its location prior to removal (URL or product name).
- A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification.
- Your full name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the competent courts and will accept service of process from the original complainant.
- Your physical or electronic signature.
Upon receipt of a valid Counter-Notice, we will forward it to the original complainant. If the complainant does not notify us of a court action within 10–14 business days, we may, at our discretion, restore the removed content.
5. Repeat Infringer Policy
In accordance with the DMCA and DSA, Modelium Club maintains a repeat infringer policy. We will terminate the accounts of Creators who are found to be repeat infringers of intellectual property rights.
Specifically:
- First valid infringement notice: content removed, Creator warned.
- Second valid infringement notice: content removed, account suspended pending review.
- Third valid infringement notice: account permanently terminated, all associated content removed.
We reserve the right to accelerate this process or act more severely where infringement is wilful, systematic, or involves clearly illegal content (e.g. content promoting violence or illegal activity).
6. Platform Liability Limitation
Modelium Club operates as a hosting intermediary under both the DMCA safe harbour (17 U.S.C. § 512) and the EU E-Commerce Directive / DSA hosting exemption. We are not liable for copyright infringement or illegal content uploaded by Creators, provided that:
- we do not have actual knowledge of the specific infringing or illegal content; and
- upon obtaining such knowledge, we act expeditiously to remove or disable access to the content.
This limitation of liability does not apply if we are found to have had actual knowledge of infringement and failed to act, or if we have received financial benefit directly attributable to the infringing activity while having the ability to control it.
7. Abuse of Takedown Process
Filing a false, fraudulent, or bad-faith DMCA or DSA notice is a serious matter. Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing may be liable for damages, including costs and legal fees.
We reserve the right to reject, disregard, or report to law enforcement any notices that we reasonably believe to be made in bad faith.
8. Other Illegal Content
If you wish to report content on Modelium Club that is illegal for reasons other than copyright (e.g. child safety, terrorism, illegal weapons, fraudulent content), please contact us at info@modelium.club or use the report function on the relevant product page.
We take such reports seriously and will cooperate with competent authorities as required by law.
9. Changes to this Policy
We may update this Policy from time to time. Material changes will be posted on the Site with a revised effective date.
