Affiliate Program Agreement

Effective Date: 23 March 2026

This Affiliate Program Agreement (“Agreement”) is entered into between Modelium Club (“Company”, “we”, “us”) and the individual or entity applying to join our affiliate programme (“Affiliate”, “you”).

By submitting an affiliate application or using your affiliate tracking link, you agree to be bound by this Agreement in full.

1. Programme Overview

The Modelium Club Affiliate Programme allows approved Affiliates to earn commissions by referring new customers to https://modelium.club who subsequently complete qualifying purchases.

Participation in the Programme is subject to approval at our sole discretion. We may decline or revoke affiliate status at any time without stating reasons.

2. Definitions

  • “Affiliate Link” means the unique URL provided to you containing your affiliate tracking identifier.
  • “Qualifying Purchase” means a purchase of a Digital Product completed by a new customer who arrives at the Site via your Affiliate Link, where the purchase is not subsequently refunded or charged back.
  • “Commission” means the percentage of the net sale value of a Qualifying Purchase payable to you as compensation for the referral.
  • “Cookie Window” means the period during which a click on your Affiliate Link is attributed to you, currently set to 30 days from the click date.

3. Commission Structure

The standard commission rate is 10% of the net sale value (excluding VAT and payment processing fees) of each Qualifying Purchase attributed to your Affiliate Link.

Commission rates may be changed by us with 30 days’ written notice. Changes will not affect commissions already earned on completed Qualifying Purchases prior to the change.

Commissions are only earned on Qualifying Purchases. Free downloads, failed payments, refunded orders, and chargebacks do not generate commissions. If a previously paid commission relates to an order that is subsequently refunded or charged back, we will deduct the corresponding commission from your future payouts or recover it directly.

4. Tracking and Attribution

Sales are attributed to you via cookies placed when a visitor clicks your Affiliate Link. Attribution follows a last-click model within the Cookie Window.

We do not guarantee that all clicks will result in attributed sales. Technical factors such as ad blockers, browser privacy settings, or cookie deletion may prevent accurate tracking. We are not liable for untracked sales.

5. Payment of Commissions

Commissions are paid monthly in arrears, provided that:

  • your unpaid commission balance has reached the minimum payout threshold of EUR 100;
  • you have provided valid payout details (bank transfer or PayPal);
  • there are no open disputes or investigations related to your account.

Payments are made in Euros (EUR). You are responsible for any currency conversion fees or taxes applicable in your jurisdiction.

Commissions will be forfeited if your account is terminated for cause. Commissions earned in good faith prior to termination for non-cause reasons will be paid out in the next regular payout cycle.

6. Affiliate Obligations

6.1 Permitted Promotion Methods

You may promote Modelium Club via:

  • your own website, blog, or social media channels;
  • email newsletters to your own opt-in subscriber list;
  • YouTube, TikTok, Instagram, or other video/content platforms;
  • 3D printing communities, forums, and groups (where permitted by those platforms).

6.2 Prohibited Promotion Methods

The following are strictly prohibited and will result in immediate termination and forfeiture of commissions:

  • Cookie stuffing or any other fraudulent manipulation of tracking cookies.
  • Bidding on our brand name (“Modelium Club”, “modelium.club”) or confusingly similar terms in paid search advertising (Google Ads, Bing Ads, etc.) without our prior written consent.
  • Sending unsolicited commercial email (spam) or promoting via purchased or rented email lists.
  • Creating fake reviews, false testimonials, or misleading comparative claims about Modelium Club or competitors.
  • Misrepresenting prices, discounts, or features of Modelium Club products.
  • Placing your Affiliate Link in pop-ups, pop-unders, or toolbars without the user’s awareness.
  • Using adware, malware, or browser extensions to inject or replace affiliate tracking codes.
  • Promoting via coupon aggregator sites without our express permission.

6.3 Disclosure Requirement

You must clearly and prominently disclose your affiliate relationship with Modelium Club in all promotional materials, in compliance with:

  • EU Directive 2005/29/EC on Unfair Commercial Practices;
  • applicable national advertising standards; and
  • the FTC Endorsement Guidelines (if targeting US audiences).

Acceptable disclosure language includes (but is not limited to): “This link is an affiliate link. If you purchase through it, I may earn a commission at no extra cost to you.”

Failure to disclose your affiliate relationship may result in immediate termination of your affiliate account and forfeiture of all unpaid commissions.

7. Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable licence to use our brand name, logos, product images, and promotional materials (“Modelium Club Assets”) solely for the purpose of promoting the Programme in accordance with this Agreement.

You may not:

  • alter, distort, or modify Modelium Club Assets;
  • use Modelium Club Assets in any way that suggests an endorsement or partnership beyond the affiliate relationship;
  • register domain names, social media handles, or email addresses that incorporate our brand name or confusingly similar variations without our prior written consent.

8. Relationship of the Parties

You are an independent contractor. Nothing in this Agreement creates an employment, partnership, joint venture, agency, or franchise relationship between you and Modelium Club. You have no authority to make any representations, commitments, or agreements on our behalf.

You are solely responsible for all taxes, social security contributions, and other statutory obligations arising from commissions you receive.

9. Confidentiality

You agree to keep confidential any non-public information shared with you by Modelium Club in connection with the Programme, including commission rates, performance data, and technical details, and not to disclose such information to third parties without our prior written consent.

10. Term and Termination

This Agreement is effective from the date of your affiliate approval and continues until terminated by either party.

Either party may terminate this Agreement at any time with 14 days’ written notice. We may terminate immediately and without notice if:

  • you breach any provision of this Agreement;
  • we determine that you have engaged in fraudulent activity;
  • you violate any applicable law or regulation.

Upon termination: your Affiliate Link will be deactivated; unpaid commissions earned in good faith on valid Qualifying Purchases will be paid in the next regular cycle; commissions on pending or disputed orders will be held until resolution.

11. Limitation of Liability

Our total liability to you under this Agreement shall not exceed the total commissions paid to you in the three months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, or consequential damages.

12. Modifications

We may modify this Agreement at any time with 30 days’ written notice. Your continued participation in the Programme after the effective date of changes constitutes acceptance. If you do not agree, you must terminate your participation before the changes take effect.

13. Governing Law

This Agreement is governed by the laws of Estonia. Disputes shall be resolved in the competent courts of Estonia.
