Terms of Service & End User License Agreement

Effective Date: 23 March 2026

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE OR PURCHASING ANY PRODUCTS. BY ACCESSING OR USING MODELIUM.CLUB, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

1. Introduction and Acceptance

These Terms of Service and End User License Agreement (collectively, the “Terms”) govern your access to and use of Modelium Club (“we”, “us”, “our”), operated via the website modelium.club (the “Site”), and all associated digital products and services.

These Terms constitute a legally binding agreement between you (“User”, “you”) and the operator of Modelium Club. By registering an account, browsing the Site, or completing a purchase, you confirm that you have read, understood, and agree to these Terms in their entirety.

If you are accepting on behalf of a company or legal entity, you represent that you have authority to bind that entity to these Terms.

2. Definitions

“Site” means the website accessible at modelium.club and any associated subdomains or mobile applications.
“Digital Product” or “Model” means any three-dimensional design file (including but not limited to .STL, .OBJ, .3MF, .STEP formats) made available for purchase or download on the Site.
“License” means the non-exclusive, non-transferable, revocable right to use a Digital Product as specified in Section 6 (EULA) of these Terms.
“Bundle” means a collection of two or more Digital Products offered together at a combined price. Each individual Model within a Bundle is subject to the same License terms.
“Content” means all materials available on the Site, including Digital Products, images, descriptions, text, and other media.
“Creator” means a third-party individual or entity that uploads and offers Digital Products for sale via the Site.

3. Eligibility and Account Registration

You must be at least 18 years of age and capable of forming a legally binding contract to use the Site. By using the Site, you represent and warrant that you meet these requirements.

When creating an account, you agree to:

provide accurate, current, and complete information;
maintain and update your information to keep it accurate;
keep your password confidential and not share it with third parties;
notify us immediately at info@modelium.club if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that contain false information or that are used in violation of these Terms.

4. Digital Products and Purchases

4.1 Nature of Purchase

When you purchase a Digital Product on the Site, you are purchasing a limited License to use that product in accordance with Section 6 (EULA) of these Terms. You are NOT purchasing ownership of the file, copyright, or any intellectual property rights in the design.

4.2 Pricing and Payment

All prices are displayed in Euros (EUR) and include applicable VAT unless otherwise stated. We reserve the right to change prices at any time; price changes will not affect purchases already completed.

Payments are processed by Stripe, Inc., a third-party payment processor. By completing a purchase, you agree to Stripe’s Terms of Service and Privacy Policy. We do not store your full payment card details on our servers.

4.3 Bundles

Bundles are pre-configured collections of Digital Products sold at a combined price. Each Digital Product within a Bundle is subject to the same License restrictions as individually purchased Models. Bundles cannot be partially refunded.

4.4 Delivery

Upon successful payment, Digital Products are made available for immediate download via your account dashboard and/or by download link sent to your registered email address. We are not responsible for delays caused by factors outside our control, including but not limited to email delivery failures on the recipient’s side.

5. Right of Withdrawal — Important Notice for EU Consumers

IMPORTANT: BY COMPLETING YOUR PURCHASE AND TICKING THE ACKNOWLEDGEMENT CHECKBOX AT CHECKOUT, YOU EXPRESSLY REQUEST IMMEDIATE ACCESS TO THE DIGITAL CONTENT AND ACKNOWLEDGE THAT YOU THEREBY LOSE YOUR 14-DAY RIGHT OF WITHDRAWAL UNDER EU CONSUMER RIGHTS DIRECTIVE 2011/83/EU.

Under EU Consumer Rights Directive 2011/83/EU, consumers ordinarily have a 14-day right of withdrawal from distance contracts. However, Article 16(m) provides that this right does not apply to contracts for the supply of digital content not supplied on a tangible medium where:

performance has begun with the consumer’s prior express consent; and
the consumer has acknowledged that they thereby lose their right of withdrawal.

By ticking the acknowledgement checkbox at checkout, you provide this express consent and acknowledgement. Once the file is made available for download, no refund will be issued except as set out in our Refund Policy.

If you do NOT wish to waive your right of withdrawal, do not tick the acknowledgement checkbox. Your purchase will not proceed until you do so.

Nothing in this Section affects your statutory rights in relation to products that are faulty, misdescribed, or not of satisfactory quality.

6. End User License Agreement (EULA)

This Section 6 is your license agreement. It defines exactly what you may and may not do with the Digital Products you purchase. Violation of this Section constitutes grounds for immediate termination of your license and account.

6.1 Grant of License

Subject to your compliance with these Terms and payment of the applicable fee, Modelium Club grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:

download and store the Digital Product for your personal use;
print physical copies of the design using a 3D printer for your own personal, non-commercial use;
modify the design files solely for your own personal use (modified files remain subject to all restrictions herein).

6.2 Permitted Uses

You MAY:

print the model for personal display, hobby, or personal gifting purposes;
use the model to create prints for personal educational or learning purposes;
print and give away (not sell) a limited number of physical prints to friends or family for non-commercial purposes.

6.3 Prohibited Uses

You MAY NOT, without our prior written consent:

sell, rent, lease, or otherwise commercially distribute physical prints of the model;
sell, redistribute, sublicense, share, upload, or otherwise transfer the digital file (in original or modified form) to any third party or on any platform;
use the Digital Product for any commercial purpose, including manufacturing products for sale;
use the Digital Product in a commercial 3D printing service where prints are sold to third parties;
claim authorship or ownership of the design;
remove or alter any copyright notices, watermarks, or attribution embedded in or associated with the file;
use the design in NFTs, AI training datasets, or any form of digital re-sale;
reverse-engineer the design for the purpose of creating a competing product.

6.4 Commercial License

If you wish to use a Digital Product for commercial purposes (including selling physical prints), you must purchase a separate commercial license. Please contact us at info@modelium.club for commercial licensing options. Not all models are available under a commercial license; availability depends on the Creator’s permissions.

6.5 License Scope for Bundles

Each Digital Product included in a Bundle is licensed individually under the terms of this Section 6. Purchasing a Bundle does not grant any additional rights beyond those described above for each individual model.

6.6 Revocation

We reserve the right to revoke your License immediately upon breach of any provision of this Section 6 or any other provision of these Terms. Upon revocation, you must delete all copies of the affected Digital Product(s) from your devices.

7. Intellectual Property

All intellectual property rights in the Site, its original content, features, and functionality are owned by or licensed to Modelium Club. Nothing in these Terms transfers any intellectual property rights to you.

The Digital Products available on the Site are protected by copyright and other intellectual property laws. The copyright in each Digital Product is retained by the respective Creator or by Modelium Club, as applicable.

Modelium Club® and related logos are trademarks of the operator. You may not use these marks without our prior written permission.

8. Third-Party Content and Creator Content

The Site may feature Digital Products created and uploaded by third-party Creators. Modelium Club does not warrant or guarantee the accuracy, quality, fitness for purpose, or originality of Creator content.

Creators represent and warrant to Modelium Club that they own or have all necessary rights to the content they upload, and that their content does not infringe the intellectual property rights of any third party.

Modelium Club operates as a hosting platform and is not liable for intellectual property infringement by Creators. We have in place a notice-and-takedown procedure described in our Copyright / DMCA Policy available at https://modelium.club/dmca-policy.

9. Prohibited Conduct

You agree not to use the Site to:

violate any applicable law or regulation;
upload or distribute malware, viruses, or any other harmful code;
attempt to gain unauthorised access to any part of the Site or its infrastructure;
scrape, spider, or systematically download content without our written permission;
post false, misleading, or fraudulent content or reviews;
harass, abuse, or harm other users or Creators;
circumvent any technical protection measures on the Site.

10. Disclaimer of Warranties

THE SITE AND DIGITAL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

Digital Products will be compatible with any specific 3D printer, material, or slicing software;
printed results will match renders or preview images;
the Site will be uninterrupted, error-free, or free from viruses;
any defects in the Site will be corrected.

Nothing in this Section limits statutory warranties that cannot be excluded under applicable EU law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODELIUM CLUB AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total cumulative liability to you for any claims arising from or related to these Terms or the Site shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

These limitations do not apply to: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be limited by law under your jurisdiction.

12. Indemnification

You agree to indemnify, defend, and hold harmless Modelium Club, its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

your violation of these Terms;
your use of the Site or Digital Products outside the scope of the granted License;
any content you upload to the Site;
your violation of any third party’s intellectual property or other rights.

13. Termination

We may suspend or terminate your account and access to the Site at any time, without notice, if we reasonably believe you have violated these Terms.

Upon termination:

your License to all Digital Products is revoked;
you must delete all downloaded Digital Product files from your devices;
you will not be entitled to a refund for purchases made prior to termination (except where required by law).

Sections 6.3, 7, 10, 11, 12, and 15 survive termination of these Terms.

14. Modifications to Terms

We reserve the right to update or modify these Terms at any time. We will provide at least 14 days’ notice of material changes by posting the updated Terms on the Site with a revised effective date and, where practicable, by email to registered users.

Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the European Union and Estonia.

Any disputes arising from these Terms or your use of the Site shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes may be submitted to the competent courts of Estonia.

If you are a consumer resident in the EU, you may also use the European Commission’s Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

16. Miscellaneous

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Modelium Club with respect to the Site.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
Language: These Terms are provided in English. In case of discrepancy between translations, the English version prevails.
